Attorneys for Donald Trump argue that the President-elect should be allowed to postpone his defense of a civil fraud lawsuit over Trump University until after his inauguration because the Republican election victor will be too busy during the transitional period.
Trump’s lawyers filed a motion with the federal court in San Diego, California, last week, seeking to delay the November 28 trial until after their client is settled in the White House. They claim that otherwise he will not be able to properly focus on either the suit or the mission to smoothly shift from businessman and reality star to commander in chief.
According to the lawyers, the importance of the upcoming months before Trump’s inauguration shouldn’t be understated, as the real-estate-king-turned-president-elect must receive daily security briefings, make executive appointments and establish relationships with members of Congress, governors and foreign leaders, among other duties, which will consume all of Trump’s time and energy.
“The President-Elect should not be required to stand trial during the next two months while he prepares to assume the Presidency. The time and attention to prepare and testify will take him away from imperative transition work at a critical time.” the lawyers wrote, as cited by Politico.“
The case at issue is one of two class-action fraud suits filed by former customers of the real estate seminar program. The plaintiffs allege that the now-defunct Trump University failed to deliver on promises made in advertisements and that premium packages they purchased were a waste of money.
Last week US District Judge Gonzalo Curiel, whom Trump sharply criticized during the campaign as biased because of his Mexican heritage, strongly urged both sides to settle prior to the trial date in order to avoid further complications.
